Linky: Legal action: Let's go!
It is not 1000 complainants but more than 2000 which are engaged in a collective and inter-regional legal action led by Maître Raffin.(see below).As for the Saône et Loire, the battery has collected 280 files which are currently submitted before the courts of Chalon- sur -saône and Mâcon.This is without counting more than 400 members who refuse this counter, the 600 sympathizers and all the anonymous people who are individually opposed to the installation of this Communicating Copper Linky.The very relative rurality of the Saône et Loire alone does not explain the percentage (77 %) less of installations carried out by Enedis but it is the expression of a real resistance of our department! The set of collectivescomplainants, whose battery wants to enforce the rights of users: that we are no longer taken as targets to enrich capitalist societies in defiance of our privacy, our health and/or, quite simply, life onEarth.At a time when an ecological conscience seems to federate a growing number of people, how to validate everyday tools which will always be more energy -consuming, which lead to throwing devices in working order alone? We want to be heard andrecognized the health problems of electro-hyper-sensitive people (EHS).The multiplication of radiation can affect each and each of us, which can make, for those who are victims, the daily life unbearable.Furthermore, we want to protect our privacy in the face of a tool that aims to collect information from our lifestyle.We ask for respect for the European directive which allows free choice, therefore our right to refuse the Linky counter in the name of life and freedom.Linky is not ecological: replacement of 35 million meters, in working order, by others of a shorter lifespan (10/20 years instead of 60).These new counters mainly lead to an increase in electricity consumption evaluated by ADEME to 500 GWh (500 billion watt-hour) per year, the consumption of 400,000 households.Linky is not a source of economy, and it is not free: a few years ago, like other associations and collectives, let's repeat that neither the counter nor its installation are free.It is true that, without state of mind, Enedis wrote ... - to subscribers: "You have absolutely nothing to pay either now or later.The costs of this intervention are covered by Enedis.Enedis had indeed announced to take charge of the cost of deployment, i.e. 5.39 billion euros: 10% from its equity and the rest thanks to a loan from the European Investment Bank (BEI) to aadvantageous rate of 0.77 %.But in the end, it is the consumer who will reimburse the cost of the Linky counter, and without benefiting from the very advantageous BEI rate.In its report, the Court of Auditors estimated it at 4.6%.Which represents half a billion euros in additional interests for Enedis.We did not invent anything, the sources were there in front of everyone, we just had to bend down to water:-article R341-7 of the Energy Code of December 30, 2015:
"The costs actually incurred related to the counting systems implemented by public networks managers in accordance with the prescriptions of the decree provided for in article R.341-6 fall into the charges to be covered by the prices for using public electricity transport and distribution networks.»(= Turpe tax)
